Cattery Sales Contract

- This agreement is between Diamondsgems, hereinafter known as the Seller and ______________________, hereinafter known as the Buyer. The price is in the amount of $______________, excluding transportation costs, veterinary costs or any other miscellaneous fees not otherwise noted here. The Seller agrees to sell the Buyer the cat, named _________________ born _____________________, registration number ______________________ registered with the Cat Fancier’s Association Inc., PO Box 1005, Manasquan NJ, USA 08736.
- If this cat/kitten is sold as a pet, it is agreed that the pet must be spayed/neutered by the age of eight months, after proof of alteration CFA registration papers will be available.
- Under no circumstances will this cat/kitten, nor the offspring be sold, leased, or given to any pet shop, research lab, or similar facility. Adequate indoor sanitary facilities well be provided and this cat will not ever be allowed to roam freely outside.
- Any and all transportation costs are to be paid by the Buyer. Expenses may include but are not limited to: airline fees, veterinary examination, vaccines including rabies and micro-chipping where deemed applicable per country guidelines, health certification as required by an airline and an airline-approved carrier. Delivery shall be made at a time and place agreeable to both parties. If the cat is being shipped by air and the airline will not accept live animals due to weather conditions at either the point of departure or arrival, delivery will be made as soon as clearance is received from the air carrier and at the time agreeable to both parties.
- The Seller guarantees that the kitten/cat is healthy at the time of delivery. A record of all vaccinations administered will be provided. The seller insists a complete examination be performed on the cat/kitten by the Buyer’s own veterinarian within 3 days after delivery. If the health of the kitten/cat is not satisfactory, it may be returned within 10days after receipt. A vet certificate describing the health problems must be provided. Failure to do this will result in the health guarantee being nul and void.
- If at any time the kitten/cat becomes seriously ill or dies, the Buyer will notify the Seller as soon as possible. The buyer will provide a necropsy or veterinary health certificate at the Buyer’s expense. If the illness or death is due to a congenital problem, the Seller will replace with a kitten/cat of equal value as available. This guarantee is limited to the first year of the kitten/cat’s life.
- If for any reason within 24 hours of the receipt of the cat/kitten the Buyer is not satisfied with the quality or condition of the cat/kitten, the Buyer may return the animal to the Seller for a full refund minus a $200 fee. Any related expenses to the shipping or the diagnosis of the cat/kitten will not be refunded. The following conditions must be met: The Buyer must notify the Seller of the decision of return within 24 hours. The Buyer must have kept the cat/kitten isolated from other animals or their environments. The buyer must pay return shipping costs.
- All transportation costs for returning or replacing an animal are the responsibility of the Buyer.
- The Buyer will maintain vaccinations and provide for the best possible care, feeding and welfare of the cat/kitten. The Buyer will give love and affection as befits a lifelong companion and friend.
- The seller assumes responsibility for a queen or stud to produce viable kittens. If the cat/kitten is not breeding after two years of age, the Seller will opt to replace the cat/kitten at no charge excluding shipping costs and related expenses or returned money. This option is at the Seller’s discretion. In addition the Seller will notify the Buyer if the cat is to be returned to the Seller or neutered/spayed, either at the Buyer’s expense. There is often a waiting list for new kittens or cats.
- The Buyer understands that show quality kittens/cats are exceptional and possess the qualities set forth in the CFA Show Standards. They are sold as show possibilities but with no guarantee of actual show performance.
- The buyer agrees that the cat/kitten will only be used in the Buyer’s breeding program. No outside stud service or leasing is to be preformed under any circumstances. There will be no co-ownership of the cat/kitten nor shall there be a transfer of ownership while the cat is still breeding. Before spay/neutering the cat/kitten, the Buyer will notify the Seller of their intent. A cat/kitten cannot be spayed or neutered until the Seller has been notified. The buyer also agrees that before the kitten/cat is resold or placed in another home, the Buyer will give the Seller first refusal to repurchase the animal at no more than ½ the original price.
- No whole progeny out of this kitten/cat are to be sold/placed back into Region 4 as defined by the CFA without prior written approval from the Seller. If at any time the Seller determines that the Buyer is violating the terms of this contract and that the cat/kitten is at risk, the Seller reserves the right to reclaim the cat/kitten with no costs refunded to the buyer.
The Buyer agrees to the terms and stipulations outlined in this contract. Both parties honour this as a legally binding contract. In the case of any legitimate legal disputes regarding this contract, the Buyer assumes any court costs required to settle the dispute.
